CFPB MONTHLY SNAPSHOT SPOTLIGHTS MORTGAGE COMPLAINTS
WASHINGTON, D.C. – Today the Consumer Financial Protection Bureau (CFPB) released a monthly complaint snapshot highlighting consumer complaints about mortgages. The snapshot shows that consumers continue to report experiencing problems with mortgage servicers. This month’s report also highlights trends seen in complaints coming from Tennessee. As of Jan. 1, 2017, the Bureau handled approximately 1,080,700 consumer complaints across all products nationwide.

CFPB AND NEW YORK ATTORNEY GENERAL SUE RD LEGAL FOR SCAMMING 9/11 HEROES OUT OF MILLIONS OF DOLLARS IN COMPENSATION FUNDS
WASHINGTON, D.C. – Today the Consumer Financial Protection Bureau (CFPB) and the New York Attorney General filed a lawsuit against RD Legal Funding, LLC, two related entities, and Roni Dersovitz, the companies’ founder and owner, for allegedly scamming 9/11 heroes out of money intended to cover medical costs, lost income, and other critical needs. RD Legal also allegedly conned National Football League (NFL) concussion victims. The CFPB and New York Attorney General allege that the illegal scheme deceived 9/11 first responders with cancer and other illnesses and football players with brain injuries out of millions of dollars by luring them into costly advances on settlement payouts with lies about the terms of the deals. In the suit filed in federal court, the CFPB and the New York Attorney General seek to put an end to the company’s illegal practices, obtain relief for the victims, and impose penalties.

CUNA: CFPB STRUCTURE IS NOT WORKING FOR CREDIT UNIONS
Changes to the Consumer Financial Protection Bureau structure represent a reasonable improvement to a flawed structure, not an attempt to undermine the bureau, CUNA wrote to Sen. Sherrod Brown (D-Ohio) Monday. CUNA’s letter points out that since the Dodd-Frank Act was first proposed as a bipartisan commission by Sen. Elizabeth Warren (D-Mass.) and the Obama Administration, CUNA has agreed that it is the appropriate structure for the bureau.

FEDERAL APPEALS COURT REFUSES TO LET DEMOCRAT AGS AND CONSUMER GROUPS INTERVENE IN CFPB’S CONSTITUTIONALITY CASE
On Thursday, the U.S. Court of Appeals for the D.C. Circuit issued a per curiam order (a decision handed down by the court as a whole, without identifying any particular judge as the author) without a written opinion in PHH Corp., et al. v. Consumer Financial Protection Bureau, No. 15-01177 (D.C. Cir. Feb. 2, 2017). The order denied an attempt by 17 Democrat attorneys general to intervene in the appeals court case that found the Consumer Financial Protection Bureau’s structure was unconstitutional. The coalition was led by Connecticut’s Attorney General George Jepsen.

CFPB AND STATE OF VIRGINIA TAKE ACTION AGAINST WOODBRIDGE GOLD & PAWN FOR DECEIVING CONSUMERS ABOUT LOAN COSTS
WASHINGTON, D.C. – The Consumer Financial Protection Bureau (CFPB) and the Attorney General of Virginia took action today against Woodbridge Coins and Jewelry Exchange, Inc., doing business as Woodbridge Gold & Pawn, for deceiving consumers about the actual annual costs of its loans. The CFPB and the Virginia Attorney General alleged that the company broke the law by misstating the charges associated with pawn loans. The CFPB and the Virginia Attorney General are filing a complaint and a proposed consent order in federal court. If approved by the court, the proposed order would require Woodbridge Gold & Pawn to pay $79,000 in consumer relief and penalties and end deceptive disclosures.

FTC RETURNS NEARLY $20 MILLION IN ADDITIONAL REFUNDS TO T-MOBILE CUSTOMERS
The Federal Trade Commission is mailing refund checks totaling nearly $20 million to more than 617,000 T-Mobile customers who had third-party charges added to their mobile bills. These refunds are the result of a 2014 settlement with T-Mobile, which also involved all 50 states and the District of Columbia, as well as the Federal Communications Commission.
